Limitation periods in Manitoba generally run from the date the cause of action arises. There are few limitation periods based on discoverability of the cause of action. Unlike some other jurisdictions, limitation periods in Manitoba vary depending on the nature of the claim. Many claims expire within two years of the date the cause of action arose, but some expire after six years (for example, some equitable causes of action, breach of contract, damage to real property) and certain proceedings involving real property have 10 year limitation periods.
Where a limitation period has expired before the cause of action was discovered by the plaintiff, the plaintiff may apply for a court order extending the time within which to commence an action provided that the application, among other things, is filed in a timely fashion.
