Summary Judgments are a form of Chambers application that can be initiated if a party can prove that a claim, as articulated in a Notice of Civil Claim or Third Party Notice, or the corresponding response has no merit and is bound to fail should the matter proceed to trial. These applications are made only in instances where it is clear that the other party cannot succeed because he or she has no case or defence, based on the pleadings alone. The main question that the court considers on these applications is whether there is any genuine issue between the parties that requires a trial to resolve.
